Terms and Conditions for Subscribing to the Bin Dowal Mobile Banking Application Service Affiliated with Bin Dowal Islamic Microfinance Bank
First: Definition of the service :
The Bin Dowal Mobile Banking Application is a modern electronic cash tool that enables you to manage your money and perform financial transactions easily, quickly, and securely via your mobile phone, without the need to have a prior bank account. You can also link your bank account at Bin Dowal Islamic Microfinance Bank to the application to expand your options. The service is provided through a secure electronic system licensed by the Central Bank of Yemen, allowing you to send and receive money transfers, pay and receive payments, settle utility bills (electricity, water, internet, phone), in addition to the ability to deposit and withdraw cash to and from your application account via bank branches or through a wide network of authorized agents across the Republic of Yemen.
Second: Service Objective:
This service aims to ensure financial and banking services reach the largest possible segment of users with quality, security, and minimal cost.
Third: Obligations of the Service Parties:
- (Service Provider’s Obligations) The Bank:
- The bank opens an electronic account in Yemeni Rial currency for the service applicant (the customer) linked to their owned or possessed mobile phone number to enable execution and receipt of financial transactions.
- Send electronic notifications or SMS messages to the customer about completed financial transactions unless a technical failure prevents delivery of such notifications or messages.
- The bank retains customers’ data and documents, as well as consolidated account movements, for five years, while committing to confidentiality and the security of customer information.
- This service is provided through bank branches, authorized agents, and service points spread throughout the governorates of the republic, with an updated list of all agents published on the bank’s website.
- The bank receives customer complaints via contact numbers listed on the website, records them, and processes them in a special register where the problem and resolution procedures are documented.
- (Service User’s Obligations) The Customer:
- The customer must comply with all applicable laws and regulations in the Republic of Yemen related to using the service, especially the Electronic Transactions Law, Anti-Money Laundering and Terrorism Financing Law, instructions from relevant regulatory authorities, and any laws or instructions issued thereafter.
- The customer must keep their service password confidential, change it periodically to maintain secrecy, and must not disclose it to any person or entity. The customer bears full responsibility for its use whether by themselves or others, with or without their permission.
- The customer, who is fully legally and legitimately competent, authorizes Bin Dowal Islamic Microfinance Bank to deduct transactions resulting from using the Bin Dowal Mobile Banking Application from their electronic account opened with the bank as well as their linked bank account if they agreed to link it. Signing this contract electronically or in paper form constitutes conclusive evidence of this authorization.
- The customer must verify the transaction before execution through the confirmation screen regarding beneficiary data, transaction amount, and others; the bank bears no responsibility for violations of this.
- The customer must ensure the agent they deal with is an authorized agent of Bin Dowal Islamic Microfinance Bank through available means; the bank assumes no responsibility for violations of this.
- The customer must be responsible for all transactions they initiate in the system via the mobile phone registered in the service. Any transaction made through this service is considered issued by the customer alone, and legally binding on them. They must reconcile transactions with the SMS messages sent by the bank, which are the sole legal reference for the customer. The customer agrees that the bank’s system outputs are legally accepted as complete evidence in all procedures and transactions.
- If bills are not paid for any reason and the amount is deducted from the customer’s account in the Bin Dowal Mobile Banking Application, the customer must object to the transaction within 24 hours of execution; otherwise, the bank bears no responsibility.
- The customer acknowledges that the phone numbers used in the service belong to them and are in their possession, and they bear full responsibility for any transactions executed through them; the bank bears no responsibility for violations of this.
- If the customer wishes to terminate the service, they must submit a written request to the bank indicating their desire to terminate the service.
- The customer must notify one of the bank’s branches or authorized agents immediately in case of loss or theft of their mobile phone linked to the service and confirm the notification in writing the following day; otherwise, the bank bears no responsibility.
Fourth: General Provisions
- The bank opens an electronic account in Yemeni Rial currency for the service applicant (the customer) linked to their owned or possessed mobile phone number to enable execution and receipt of financial transactions.
- Send electronic notifications or SMS messages to the customer about completed financial transactions unless a technical failure prevents delivery of such notifications or messages.

- If the customer violates any of the above terms.
- If the customer abuses the service or violates applicable laws.
- In case of the customer’s death or loss of legal capacity upon the bank’s knowledge.
- If there is no balance in the customer’s account opened with the bank, and the customer has not deposited or received financial transactions in their account for six months from the date of last use.
- The bank has the right to reverse any amount mistakenly credited to the customer’s account without needing to revert to them, and the customer will be notified by SMS of the reversal.
By clicking the (Agree) button, the subscriber agrees to all terms and conditions in this agreement and confirms that all personal information provided for the purpose of opening an account in the Bin Dowal Mobile Banking Application is accurate and they bear full responsibility for it.
Terms and Conditions of Use of Bank Account
- The account holder authorizes the bank to mix its funds with the bank's funds. The bank has the right to utilize them for a good loan with its security. This account does not participate in any profit and does not incur any losses.
- The minimum account shall be subject to the determination of the bank's management at the time of creativity. The account shall be dealt with through cash withdrawal or using the electronic services provided by the bank. The terms of these services shall be considered as part of the conditions for opening the account. The customer shall be bound by all transactions issued on the account and the resulting financial and legal obligations.
- The account holder can withdraw and deposit from his account at any time and from any branch of the bank and the bank is entitled to calculate its commission as determined by the bank's management.
- This account in the Bank is characterized by complete confidentiality. No other person may consult it without written authorization, judicial decision or order from the supervisory and supervisory authorities authorized to do so and is subject to all applicable laws relating to banking and financial work in the Republic of Yemen.
- The Bank's records and accounts are conclusive evidence of what the Bank's party is entitled to.
- The Bank has the right to amend the terms of the Account and the terms of its electronic and bank services at any time. The new conditions will be displayed in the Bank's boards in the branches. In case of objection, the Customer has the right to apply for closure of the Account.
- Any notification from the bank to the customer of an SMS for his mobile approved by the bank is valid and legal.
- The Bank has the right to cancel the Account or to cancel the services associated with the Account when it deems it at any time, in particular in the following cases:
- If the customer misuses the service.
- In the event of the client's death or loss of eligibilit.
- In the absence of a balance in the customer's account open to the bank and the customer has not provided an amount for the account within three months from the date of last use, the account carries and discontinues all the services associated with it.
- The Bank has no legal or moral liability resulting from the change of rates or the lack of currency because currency rates change from moment to moment and are subject to supply and demand and may not at times be able to provide them.
- The Bank shall not be liable if it is unable to provide any of the services or to fulfil any of the obligations set forth in these Terms if this is directly or indirectly due to any dispute or circumstance beyond its control. No liability shall be incurred by the Bank for any subsequent direct or indirect damage related to the use of the cashier's card on any cashier, POS or other device or due to the effectiveness or disruption of cash from any ATM.
- All accounts of any kind are considered to be open in the customer's name or in his name in the future at the bank or any of its branches as guarantors of each other regardless of their names The Bank, in the event that the Customer fails to fulfil its obligations in a timely manner, shall have the right to merge or consolidate all or some of these accounts and to deduct from the credit balance of any of them until the Customer has fulfilled all of its obligations before the Bank; The bank is authorized to make the set-off and deduction from the creditor's or debtor's balance, and the market exchange rate is adjusted.
- The Customer agrees to the Bank's right to deduct any amount accidentally deposited into its account by computer system, technical error, hardware fault, human error, clearing system error or other reason without any liability to the Bank and its obligation not to dispose of this amount in any way whatsoever. The Customer also agrees upon the Bank's request to return any amount accidentally deposited in the Account that the Customer has disposed of or transferred from the Account and if the Customer refuses to do so, The Bank has the right to deduct the amount from any account of the Customer with the Bank or one of its branches under which the Customer waives any claim or action against the Bank as a result of the Bank exercising its right under this Article.
Terms and Conditions of Electronic Services
- The Customer shall abide by all relevant applicable laws and regulations when using electronic services, including Anti-Money Laundering and Terrorist Financing Laws and any subsequent laws. The Customer shall be fully liable and guaranteed before the Bank and any other entity for all operations he experiences through these services.
- The use of electronic services by the customer shall be in accordance with the terms and conditions of service and within the balance of his open accounts with the bank.
- The customer is obliged to preserve the passwords of the service and to change them from time to time and not leak them to anyone. The customer bears full responsibility for the violation.
- When making any financial transaction in electronic services, you must ensure that the data is entered correctly and the customer is liable for any error.
- Electronic services are linked to the mobile number approved in the account and the customer will be able to use the service only via this number, and you will send messages (SMS) to the customer on the mobile number installed in his account and the customer will receive the PIN when activating the service on this number and must change the PIN once the message arrives (SMS) access to the mobile service and follow instructions. When this number is lost or damaged, the bank must be notified in writing at any of the bank branches. The service will be discontinued and Bin Dowal Bank will not be responsible for any operation performed prior to the suspension.
- The Bank has the right to amend the terms of service such as the maximum single transaction, the maximum day or the number of permitted transactions per month at any time and in case of objection the Customer has the right to apply for cancellation of service.
- The Customer shall abide by all transactions issued by him in the System. Any transaction performed by him through electronic services or through the Bank's website or through the applications issued by the Bank shall be legally binding on the Customer. The Customer has agreed that the Bank's reports are the sole reference for the Customer and the extracts of the Bank's system are an acceptable legal argument in full evidence in all actions and transactions conducted in accordance with this Service.
- The customer has the right to modify his mobile number and pre-entered data for a service fee and the customer bears liability for any error therein.
- Remittances sent through this service are subject to the conditions of sending and receiving remittances in the bank and the customer agrees to abide by them.
- Electronic services are linked to the customer accounts in the bank of all kinds and are subject to their terms signed by the customer when opening the account.
- The Customer acknowledges that the username and passwords are the identifier of the Customer, so any operations carried out using this means are deemed to be issued by the Customer. The Bank considers any person using it to be the Customer, and the Customer is responsible for all operations carried out using its own identification means. If the customer suspects that someone is manipulating his accounts through the service or that the user's code and passwords were detected by another party, The customer is obliged to inform the bank immediately and enhance this in writing as soon as possible The Client will be liable for all amounts incurred as a result of the use of the username and passwords until the end of the day the Bank receives the written notification from the Client.
